In view of the aforesaid finding, the prosecution has been able to establish its case against the accused that he was found obstructing the public way by encroaching the road by keeping coolers of his shop on the road having the potential to cause danger, obstruction or injury to the public and thereby committed an offence punishable U/s 283 IPC.
